BREAKING DAWN CONCERT SERIES SWEEPSTAKES OFFICIAL RULES NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT IMPROVE YOUR CHANCE OF WINNING. Eligibility: Sweepstakes open to legal residents of the 50 United States and the District of Columbia who are 13 years of age or older as of the commencement date of the Sweepstakes Period (below). Employees of Hachette Book Group USA, Inc. ("Sponsor"), and Sponsor's parent, subsidiaries, affiliates, retailers, suppliers, distributors, advertising/promotion agencies ("Promotion Entities") and their immediate family members (mother, father, brothers, sisters, sons, daughters and spouse) and/or those living in the same household with such employees, whether or not related, are not eligible to enter or win. Sweepstakes is void where prohibited by law. How to Enter: Enter by regular mail. If, despite reasonable efforts, a potential winner does not respond within three (3) days of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected. Odds of winning will depend on the number of eligible entries received. Prizes: Two (2) Grand Prizes: Each Grand Prize will consist of a trip to New York, New York between August 1, 2008 and August 2, 2008 for three people (winner, winner's parent or guardian, and winner's guest ("Winner's Group") as follows: Sponsor will arrange and pay for roundtrip coach airfare to New York, New York airport for Winner's Group; cab or coach ride to and from New York airport and hotel and between hotel and Nokia Theater in New York, New York; one (1) night's stay for three (3) people in one hotel room; "VIP treatment for Winner's Group", i.e., the opportunity, subject to availability, for Winner's Group to go backstage, have a private meet-and-greet with Stephenie Meyer, and the opportunity to be among the first in line at a local bookstore to purchase three (3) copies of the book Breaking Dawn (using a gift card with a value of $75.00 supplied by Sponsor); and three (3) tickets for Winner's Group to attend the Breaking Dawn Concert Event at Nokia Theater, August 1, 2008, 6:00 pm - 9:00 pm (ET). The airline, hotel, cab or coach, and local bookstore will be determined by Sponsor in its sole discretion. The approximate retail value ("ARV") of each Grand Prize is $ 2,250.00; total ARV for the two (2) Grand Prizes = $ 4,500.00. Note: Winner's Group must be able to travel together to and from and stay in New York, New York during the period August 1, 2008 to August 2, 2008. All travel, hotel and other arrangements must be made through Sponsor. General Prize Conditions: All applicable federal, state and local taxes are the sole responsibility of the winner. All costs and expenses, e.g., meals, not specified as part of the Prize (above) are the responsibility of each winner. No transfer, assignment, cash redemption or substitution of prize (or portion of prize) except by Sponsor due to prize unavailability and then for a prize (or applicable portion of prize) of equal or greater value as determined by Sponsor. All details and other restrictions of prizes not specified in these Official Rules will be determined by Sponsor in its sole discretion. Winner's parent or guardian will be responsible for winner, parent or guardian, and guest obtaining proper travel documentation (e.g., valid photo ID) prior to travel. Once scheduled, trip must be taken on dates and times arranged by Sponsor or prize will be forfeited in its entirety. Sponsor is not responsible for travel delays or cancellations or for Concert Series cancellation or delay (in whole or in part). There shall be no compensation or prize substitution if winner, and/or any guest is/are unable to take scheduled trip by reason of illness, family emergency, personal events, terrorism, labor strikes, weather, or other acts beyond Sponsor's control. Prize will be forfeited if parent or guardian for Winner’s Group is unable to take scheduled trip by reason of illness, family emergency, personal events, terrorism, labor strikes, weather, or other acts beyond Sponsor's control. Winner's Group: The Grand Prize winner must travel with the winner's parent or guardian. The parent or guardian must be 21 years of age or older. The Grand Prize winner's guest must be 13 years of age or older. If winner's guest is a under 18 years of age, the guest's parent or guardian must agree in writing for the benefit of Sponsor to authorize winner's parent or legal guardian to travel with guest and require the winner's parent or legal guardian at all times to accompany the guest and be responsible for the guest (in addition to winner), such agreement in a form and substance acceptable to Sponsor in its sole and absolute discretion. Grand Prize winner's parent or guardian and guest (and if guest is under 18 years of age, the guest’s parent or guardian) each must sign and return a Liability Release and (where legal) a Publicity Release as condition of prize ("Authorization Documents"). Prize Claim Documents: Each potential prize winner will be required within five (5) days of issuance of notification to: (1) execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release and any other documentation necessary for Sponsor to fulfill prizing (collectively, the "Prize Claim Documents"); (2) arrange for parent or guardian to execute and return Prize Claim Documents; and (3) arrange for guest (and if the guest is under 18 years of age a) guest's parent or guardian to execute and return Prize Claim Documents and Authorization Documents. Non-compliance with the foregoing may result in disqualification and awarding of prize to an alternate winner. If any prize notification letter or prize is returned as undeliverable, winner will be disqualified and an alternate winner may be selected. Confirmation of prize winner is subject to Sponsor's verification of the Prize Claim Documents. Sponsor is not responsible for any lost, late, incomplete, illegible, undeliverable, misdelivered, returned, mutilated, damaged, or postage due mail or communications. Publicity Release/License to Use: By participating in the Sweepstakes, each entrant irrevocably grants the Promotion Entities and their respective successors, assigns and licensee, the right to use such entrant's name, likeness, and biographical information in any and all media for any purpose, including without limitation advertising and promotional purposes, as well as in, on or in connection with the Sweepstakes and/or other promotions conducted by the Promotion Entities, and each entrant hereby releases the Promotion Entities from any liability with respect thereto. Further Documentation: If Sponsor shall desire to secure additional assignments or other documents in order to effectuate the purposes and intent of these Official Rules, then each entrant agrees to sign the same upon Sponsor's request therefor. General Liability Release/Force Majeure: Entrants (or if under 18 years of age, their parents or legal guardians) agree that the Promotion Entities (a) shall not be responsible or liable for any losses, damages or injuries of any kind resulting from participation in the Sweepstakes or any Sweepstakes-related activity, or from entrants' acceptance, receipt, possession and/or misuse of the prize(s), and (b) have not made any warranty, representation or guarantee express or implied, in fact law, with respect to the prize(s), including, without limitation, to such prize’s quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to an entrant's computer system which is occasioned by accessing Website or participating in the Sweepstakes, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen or postage-due submissions, prize notifications; or for lost, interrupted, inaccessible or unavailable postal system, networks, servers, satellites, Internet Service Providers, websites or other connections; or for miscommunications, failed, jumbled, scrambled, delayed or misdirected postal, computer, telephone or transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature: or for the sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes or the Website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person the fullest extent permitted by law. In the event Sponsor is prevented from awarding prize(s) or continuing with the Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man made epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local governing law, order, regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor's control (each a "Force Majeure" event or occurrence), then subject to any governmental approval may be required, Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes. If the Sweepstakes is terminated for Force Majeure before the designated end date, Sponsor will (if possible) select the winner(s) from all eligible, non-suspect submissions received as of the date of the event giving rise to the termination. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these rules shall not affect the validity enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
